The Supervision Agreement, Form 37M-300, is the one form every California supervisory relationship that began on or after January 1, 2022 must have. The supervisor and supervisee complete it within 60 days of starting supervision. It has three parts: the supervisor's attestations, the supervisee's attestations, and a supervisory plan you write together. You keep it.

It goes to the Board only with your Application for Licensure. It replaced the Supervisor Responsibility Statement and the Supervisory Plan, which still apply to relationships that began before 2022.

When the agreement is required, what each part asks, and where it goes are covered below.

When do you need a Supervision Agreement?

A Supervision Agreement is required for every supervisory relationship that began on or after January 1, 2022. It’s completed within 60 days of the start of supervision. You need one agreement per supervisory relationship. A new supervisor means a new agreement.

A substitute supervisor who covers more than 30 consecutive days needs their own supervisory plan.

What is in Part I, the supervisor's section?

Part I holds the supervisor's license details and 37 initialed attestations in four sets, signed under penalty of perjury.

Set

Items

What the supervisor attests

A. Qualifications

1 to 13

Active license in good standing, two of the last five years licensed, supervision training and professional development, no prior therapeutic or personal relationship with the supervisee, the one-time Self-Assessment Report

B. Employment and setting

14 to 23

Permitted settings, the supervisee’s W-2 or volunteer status, the employer oversight agreement, the private practice rule, staffing agency placements

C. Supervision

24 to 33

Group and individual limits, contact requirements, the videoconference assessment (Item 30), signing the weekly logs, crisis procedures, LEP scope

D. Other duties

34 to 37

Obtaining the prior supervisor’s information, giving the Board documentation on request, notice before ceasing to sign hours

Set A covers the validity of your supervisor’s standing. Set B covers your work setting, including the employer oversight agreement covered later on this page.

Set C is the one that touches your weekly hours. It covers group and individual limits, contact requirements, and signing your weekly logs. Item 30 is the videoconference assessment.

Your supervisor initials every item, so ask to see the form before they sign.

What is in Part II, your section?

Part II is nine initialed attestations the supervisee signs under penalty of perjury. You initial them one at a time, in form order, indicating:

  1. You know your licensing requirements.
  2. You will only work where your employer allows it.
  3. You have an active Associate registration to provide clinical services.
  4. You have an active Associate registration to earn postdegree experience.
  5. You have checked the validity of your supervisor’s license.
  6. You have a valid W-2 or volunteer status.
  7. You know your supervisor must sign your logs.
  8. You know the window in which your hours stay valid.
  9. You know you may not receive payment from clients, have proprietary interests in your employer’s business, or pay for the obligations of your employer.

Your window for valid supervised hours is six years. Starting on January 1, 2027, it becomes seven years under AB 1598.

What goes in Part III, the supervisory plan?

Part III is the supervisory plan, written by the supervisor and supervisee together, with goals and objectives for the supervision. In this part, the supervisor confirms seven ongoing duties. This includes assessing your strengths and limitations at least once a year and at the end of supervision. Both of you sign the plan.

Do you send the Supervision Agreement to the Board?

No. The supervisee keeps the signed original and submits it with the Application for Licensure. The Board can ask your supervisor for compliance documentation at any time, so keep the original somewhere safe.

What replaced the Responsibility Statement and Supervisory Plan?

Form 37M-300 replaced two older documents for relationships that began on or after January 1, 2022. For relationships that began before that date, the Supervisor Responsibility Statement and the Supervisory Plan still apply. The Responsibility Statement has one form per track: AMFT, ASW, and APCC. Experience Verification forms are a different document, and the agreement does not replace them.

If your relationship started on or after January 1, 2022, you use Form 37M-300 instead. The older documents live inside it, and the supervisory plan goes in Part III.

Confirm your supervision start date to see which forms apply to you.

What if your supervisor is not employed by your employer?

A written oversight agreement is a separate document from Form 37M-300. It’s required when the supervisor is not employed by your employer, or supervises you as a volunteer. The Board has a sample written oversight agreement. Your supervisor attests to this agreement in Part I, set B.

Supervision Agreement questions associates ask

Do trainees complete a Supervision Agreement?

Yes. The cover page of Form 37M-300 has a status field for the supervisee, which includes MFT Trainee, AMFT, ASW, and APCC. Forms can change, so check the options listed there for your status.

Where are the legal citations for each item?

The Board publishes an Index of Legal Citations that maps requirements in the Supervision Agreement to specific statutes and regulations. Use it when you want to know the law behind a specific attestation.

What if the agreement was signed late?

The agreement is due within 60 days of starting supervision and should be signed as soon as possible.

Does the agreement need to be notarized?

No. Parts I and II are signed under penalty of perjury. The form does not call for a notary.

Can the Supervision Agreement be signed electronically?

Nothing on Form 37M-300 requires a wet-ink signature.

Does one agreement cover two work settings with the same supervisor?

What matters is that you have one agreement per supervisory relationship. If your setting changes, check the setting items in Part I, set B, items 14 to 23.

What if my supervisor’s license lapses after we sign?

In Part I, your supervisor attests to an active license in good standing. If the license lapses, supervision cannot continue until that license is restored.

Can SparkHours store my signed agreement with my logs?

Yes. Your signed agreement is stored, alongside weekly e-signatures and stored supervisor records. That keeps everything you need in one place.

Keep the agreement with every signed week

Form 37M-300 manages one agreement per supervisory relationship, completed within 60 days and kept until licensure. You hold the original, and you send it to the Board with your Application for Licensure. SparkHours stores the supervisor on every week and collects the signature by email, so the agreement and the weekly logs stay together.
