Terms of Service

1. Agreement

By creating an account on SparkHours, you agree to these terms. If you do not agree, do not create an account. These terms are a legal agreement between you and SparkHours.

2. What SparkHours is

SparkHours is a clinical hour tracking tool that helps pre-licensed therapists log hours, collect supervisor signatures, and generate BBS-compliant forms. It is a recordkeeping and compliance tool. It is not a source of legal advice, clinical guidance, or official BBS communication. For questions about licensure requirements, contact the California Board of Behavioral Sciences directly.

3. Your account

When you create an account, you agree to:

  • Provide accurate information about yourself and your training
  • Keep your password secure and not share it with others
  • Be at least 18 years old
  • Use only one account per person

You are responsible for all activity under your account. If you believe your account has been compromised, contact us immediately.

4. Acceptable use

SparkHours is for tracking your own clinical training hours. You agree not to:

  • Use automated scripts, bots, or scrapers to access the service
  • Attempt to access other users' accounts or data
  • Use the service for any unlawful purpose
  • Interfere with the service's operation or security
  • Log hours on behalf of another person without their account

5. Your data

You own your data. SparkHours does not claim ownership of the hours, rollups, supervisor information, or any other content you enter. We store and process your data solely to provide the service. For details on how we handle your data, see our Privacy Policy.

6. Accuracy of your records

You and your supervisor are responsible for the accuracy of the hours you log and the rollups you submit. SparkHours provides compliance tools such as supervision ratio checks, category caps, and weekly limits as aids to help you stay on track. These tools are not a guarantee of BBS compliance. Always verify your records against current BBS requirements.

7. Electronic signatures

When your supervisor signs a rollup through SparkHours, their electronic signature constitutes their attestation that the hours recorded are accurate. You are responsible for ensuring that you have a valid supervisory relationship with the person signing your rollups. SparkHours verifies the supervisor's identity through their email address and license information, but does not independently confirm the supervisory relationship.

8. BBS compliance

SparkHours is built for current California BBS rules for AMFT, APCC, and ASW trainees. BBS requirements may change over time. We update our rulesets to reflect changes, but we do not guarantee real-time compliance with every regulatory update. If you are unsure whether a requirement has changed, check with the BBS directly.

9. Pricing

SparkHours offers a 14-day free trial with no credit card required. The subscription price is $10 per month, or $100 per year with annual billing. There is no long-term contract. You can cancel at any time. If we increase the subscription price, we will give you at least 30 days' advance notice by email before the change takes effect.

10. Service availability

We make our best effort to keep SparkHours available and reliable, but we do not offer an enterprise service level agreement. The service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice for planned maintenance when possible.

11. Limitation of liability

SparkHours is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for:

  • Inaccurate hour tracking resulting from data you entered
  • Missed deadlines or rejected licensure applications
  • Changes in BBS requirements that affect your records
  • Loss of data due to account deletion you initiated
  • Service interruptions or downtime

Our total liability to you for any claims arising from your use of SparkHours is limited to the amount you paid us in the 12 months before the claim arose. If you have not paid us anything, our liability is zero.

12. Termination

You can delete your account at any time from your profile settings. Deletion is permanent. We may suspend or terminate your account if you violate these terms, but we will give you notice and an opportunity to export your data before permanent termination, except in cases of egregious abuse.

13. Changes to these terms

We may update these terms from time to time. For material changes, we will give you at least 30 days' advance notice by email before the new terms take effect. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of SparkHours after the effective date constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Dispute resolution

If you have a dispute with SparkHours, we ask that you contact us first at [email protected] so we can try to resolve it informally.

If we cannot resolve the dispute informally within 30 days, either party may initiate binding arbitration. Arbitration will be conducted on an individual basis. You agree not to participate in class action lawsuits or class-wide arbitration against SparkHours.

Either party may bring claims in small claims court if they qualify, without first going through arbitration.
